1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Fobal ("Company," "we," "us," or "our") governing your access to and use of the Fobal website, mobile application, and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not access or use the Service.

2. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are accessing the Service from a jurisdiction where sports betting or the use of sports betting-related tools is restricted or prohibited, you are responsible for ensuring your compliance with all applicable local laws and regulations.

3. Description of Service

Fobal is a data-driven analytics platform that provides player prop predictions, statistical analysis, hit rate tracking, and odds comparison across European football leagues. The Service includes:

  • Player performance statistics and historical data analysis
  • Hit rate tracking for player prop markets (goals, shots, shots on target, assists, fouls, tackles, cards, and other markets)
  • Odds comparison across multiple bookmakers
  • Edge calculation (hit rate vs. implied odds)
  • Coverage of the Premier League, La Liga, Serie A, Bundesliga, Ligue 1, UEFA Champions League, and UEFA Europa League

4. Disclaimer — No Gambling Service

THE SERVICE IS FOR INFORMATIONAL AND ENTERTAINMENT PURPOSES ONLY.

Fobal is not a gambling platform, sportsbook, or betting service. We do not accept, facilitate, or process any bets or wagers. We do not guarantee the accuracy of any predictions, statistics, or odds displayed on the Service.

Betting involves risk. Past performance and statistical trends do not guarantee future results. You acknowledge that any decision to place a bet based on information obtained through the Service is made entirely at your own risk and discretion. We are not responsible for any financial losses incurred as a result of your betting activity.

If you believe you may have a gambling problem, please seek help from a qualified professional or contact a gambling support organization in your jurisdiction.

5. User Accounts

To access certain features of the Service, you may be required to create an account. You may register using your email address or through third-party authentication providers (e.g., Google Sign-In, Apple Sign-In). When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account at any time, for any reason, including violation of these Terms.

6. Subscription Plans and Payments

6.1 Pro Subscription

Access to the Service requires an active Pro subscription. Pro is available at €14.99/month or €149.99/year (a 17% saving versus the monthly plan) and provides unlimited props, access to all 7 leagues, season-long hit rate data, and all 11 prop markets. New users receive a 7-day free trial.

6.2 Billing

  • Pro subscriptions are billed on a recurring monthly or annual basis depending on the plan selected.
  • Payment is charged at the beginning of each billing cycle.
  • All prices are listed in Euros (€) and are inclusive of applicable taxes unless otherwise stated.
  • We reserve the right to change subscription pricing at any time. Any price changes will be communicated to you in advance and will take effect at the start of the next billing cycle.

6.3 Cancellation and Refunds

You may cancel your Pro subscription at any time. Upon cancellation, you will retain access to Pro features until the end of the current billing period. No refunds will be issued for partial billing periods. If you subscribed via the Apple App Store, cancellation and refund policies of the App Store apply.

7. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Scrape, crawl, or use automated means to extract data from the Service without our prior written consent
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Redistribute, resell, or commercially exploit the data, predictions, or analytics provided by the Service
  • Attempt to gain unauthorized access to the Service, other user accounts, or our systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the Service to develop a competing product or service
  • Share your account credentials with third parties or allow multiple users to access the Service through a single account

8. Intellectual Property

All content, features, functionality, design, text, graphics, logos, and software comprising the Service are owned by Fobal or its licensors and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

9. Data Accuracy and Third-Party Data

The Service relies on data obtained from third-party sources, including but not limited to player statistics, match data, and bookmaker odds. While we strive to ensure accuracy, we make no warranties or representations regarding the completeness, accuracy, reliability, or timeliness of any data or content displayed on the Service. Odds and statistics may be delayed, inaccurate, or incomplete. You should independently verify any information before making decisions based on it.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Fobal AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or data
  • Financial losses arising from betting or wagering activities
  • Errors, inaccuracies, or omissions in the data or predictions provided
  • Interruption or unavailability of the Service
  • Unauthorized access to your account or personal information

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO US IN SUBSCRIPTION FEES DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Indemnification

You agree to indemnify, defend, and hold harmless Fobal and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any applicable laws or regulations
  • Any betting or wagering activities undertaken based on information obtained through the Service

13. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 4, 8, 10, 11, 12, and 14.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is established, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved through good-faith negotiation between the parties. If a dispute cannot be resolved through negotiation, it shall be submitted to the competent courts of the jurisdiction in which the Company is established.

15. Modifications to the Service and Terms

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time without notice. We also reserve the right to update these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

16. Third-Party Links and Services

The Service may contain links to third-party websites, services, or content that are not owned or controlled by Fobal, including bookmaker websites. We are not responsible for the content, privacy policies, or practices of any third-party websites or services. You access third-party links at your own risk.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fobal regarding the use of the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
